Unclassified technical data may be exported without a licence in furtherance of an approved manufacturing licence or technical assistance agreement only within its scope and limitations (124.3). The U.S. party must file a copy of the concluded agreement within 30 days of entry into force and report on agreements not concluded within a year (124.4), tell DDTC within 60 days if it decides not to conclude an approved agreement (124.5), and give at least 30 days' notice of impending termination (124.6). Agreements must describe the articles, the assistance and technical data including manufacturing know-how, the duration and the territories (124.7), and must carry the required clauses, including that exported data and articles produced from it may not be transferred to a foreign person except under 126.7 or 126.18, as the agreement authorises, or with prior approval (124.8). Before the first export under an agreement the U.S. holder must tell DDTC electronically that exports have begun (123.22(b)(3)(ii)).
