Part 390: General applicability, registration, marking, accident records and ELD requirements – US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399)

US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399) 390.40-46: Intermodal equipment providers: registration, systematic inspection, repair and maintenance, DVIR responses and the motor carrier's pre-trip duty for intermodal chassis (390.40 to 390.46)

What does 390.40-46 require?

An intermodal equipment provider (IEP) that interchanges intermodal chassis and trailers must register with FMCSA, mark the equipment with its USDOT number, systematically inspect, repair and maintain it under Part 396, respond to driver vehicle inspection reports, maintain records of the equipment and its inspections, and may not interchange equipment it knows is unsafe (390.40, 390.42). The motor carrier receiving the equipment must perform the pre-trip inspection and report defects to the IEP on the DVIR, and may not operate equipment in a condition likely to cause an accident (390.44, 390.46). Roadability review of the equipment is the IEP's responsibility, with the 396.17 periodic inspection applying to chassis.
