US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399)
Part 390: General applicability, registration, marking, accident records and ELD requirements – US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399)

US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399) 390.3-5: General applicability, the duty of every employer and driver to know and comply, no aiding or abetting, and the commercial motor vehicle definition at 10,001 pounds, 9 or 16 passengers or placarded hazmat (390.3, 390.5)

What does 390.3-5 require?

The FMCSRs apply to every employer, employee and commercial motor vehicle that transports property or passengers in interstate commerce, where a CMV is a self-propelled or towed vehicle with a GVWR, GCWR, GVW or GCW of 10,001 pounds or more, designed or used to transport more than eight passengers for compensation or more than 15 passengers not for compensation, or used to transport placarded hazardous materials (390.5). Every employer must be knowledgeable of and comply with all regulations that apply, must require its employees to comply, and must instruct them in the regulations; no person may aid, abet, encourage or require a carrier or employee to violate the rules (390.3, 390.13). The exceptions in 390.3(f) (school bus operations, government, certain occasional transport, emergency relief, pipeline welders) and the intrastate thresholds set by States are applied by the carrier in a documented applicability determination.
