Parts 4 to 6: other provider duties – UK Online Safety Act 2023

UK Online Safety Act 2023 s.72: Further duties about terms of service

All user-to-user services tell users, clearly and accessibly, of their right to sue for breach of contract if content is removed or they are suspended or banned in breach of the terms of service. Category 1 services must actually enforce what their terms say they will prohibit, restrict or sanction, write those terms clearly and in enough detail for users to predict decisions, apply them consistently, provide reporting of relevant content and users, and run a complaints procedure. Status: the section is only partly in force (commencement notes list s.72 as partially commenced from 10 January 2024); the Category 1 duties apply once commenced and a service is designated.
