UK Online Safety Act 2023 s.12: Safety duties protecting children (user-to-user)

Providers take proportionate measures to mitigate risks and impacts of harm to children in each age group and operate systems to prevent children of any age encountering primary priority content (pornography, and content encouraging, promoting or instructing suicide, self-harm or eating disorders) and to protect at-risk age groups from priority content (such as abuse and hate, bullying, serious violence, dangerous challenges and stunts, and harmful substances) and identified non-designated harmful content. Unless a term of service prohibits a kind of primary priority content for all users, highly effective age verification or age estimation must be used to stop children encountering it. Terms of service explain the protections, any age-gating and proactive technology, clearly and consistently. The duties cover only parts of a service children can access, and a service may conclude children cannot access it only if age assurance normally keeps them out. In force: children's risk assessments due by 24 July 2025; safety duties from 25 July 2025, when the protection of children codes took effect (s.51).
