UK Land Registration Act 2002
Part 6: Registration: general (conclusiveness, boundaries, inspection, official copies and searches, disclosure of unregistered interests, priority protection, objections, duty to act reasonably) – UK Land Registration Act 2002

UK Land Registration Act 2002 71: Duty to disclose unregistered interests on first registration and on registrable dispositions

What does 71 require?

Where the rules so provide, an applicant for first registration must disclose to the registrar information about interests affecting the estate that fall within Schedule 1 (overriding interests on first registration), and an applicant to register a registrable disposition must disclose interests within Schedule 3 (overriding interests on disposition), so that the registrar can enter a notice and the interest ceases to override. The Land Registration Rules 2003 (rules 28 and 57, form DI) specify the interests to be disclosed and the exceptions.
