Part 6: Registration: general (conclusiveness, boundaries, inspection, official copies and searches, disclosure of unregistered interests, priority protection, objections, duty to act reasonably) – UK Land Registration Act 2002

UK Land Registration Act 2002 58-65: Conclusiveness of the register, boundaries, upgrading title and alteration

What does 58-65 require?

Registration of a person as proprietor vests the legal estate in that person even if it would not otherwise have done so (section 58), except where a further registration requirement remains. Boundaries shown on the register are general boundaries unless determined as exact under the rules (section 60); accretion and diluvion operate under section 61; the registrar may upgrade possessory, qualified or good leasehold title in the circumstances section 62 lists; defects in title may be recorded (section 64); and the register may be altered under Schedule 4 by the court or the registrar to correct a mistake, bring the register up to date or give effect to an estate, right or interest excepted from registration, with rectification against a proprietor in possession only where he caused or contributed to the mistake or it would be unjust not to rectify (section 65).
