A customer's condition of business does not by itself justify monitoring workers; the employer must be satisfied that any monitoring the customer requires is necessary and proportionate, must inform workers, and the decision rests with it. It should consider lower-risk options such as aggregated reports and refuse monitoring it is not confident complies, discussing alternatives with the customer.
