UK ICO Employment Practices and Data Protection: Monitoring Workers (2023) 1.8: 1.8 Fairness: monitor only as workers would reasonably expect, without unjustified adverse effects

The employer should monitor only in ways workers would reasonably expect and that do not cause unjustified adverse effects; a DPIA, required in some cases and advisable in all, helps show this. The ICO's examples: CCTV in changing rooms to catch thieves is unfair (a camera on the door outside, signed and time-limited, is not), and case-management productivity reports that ignore reasonable adjustments for work done outside the system are unfair and inadequate.
