UK ICO Employment Practices and Data Protection: Monitoring Workers (2023) 1.5(b): 1.5(b) Explicit consent as a condition only with a genuine, penalty-free choice

Explicit consent needs a clear written or oral statement and cannot be implied; the employer may rely on it only where workers have real choice and control and suffer no actual or perceived negative impact for refusing, which is unlikely in most employment situations. The ICO's example: biometric sign-in with a PIN alternative for those who decline.
