For a relevant regulated activity carried on in a care home, hospital or hospice, unless there are exceptional circumstances, service users whose care involves an overnight stay or accommodation must be facilitated to receive visits from family, friends or supporters at the premises; residents of care homes must not be discouraged from taking visits out of the home; and service users attending a hospital or hospice without an overnight stay must be enabled to be accompanied by a family member, friend or other supporter. The registered person must secure that visits are facilitated in a way that is appropriate, meets needs and so far as practicable reflects preferences, take the necessary and proportionate action or precautions so visits and accompaniment are safe, have regard to the care or treatment plan, and involve relevant persons in the arrangements. Nothing requires a visit without the relevant person's consent or, where the service user lacks capacity, against their best interests, nor anything inconsistent with a court order or the Mental Health Act, Mental Capacity Act or high security psychiatric services provisions; certain activities and detained persons are excluded.
