UK Health and Social Care Act 2008 (Regulated Activities) Regulations 2014 (CQC Fundamental Standards) 13: Safeguard service users from abuse and improper treatment: effective systems to prevent and to investigate abuse, no discrimination, unnecessary restraint, degrading treatment or disregard of needs, and no deprivation of liberty without lawful authority

What does 13 require?

Service users must be protected from abuse and improper treatment. Systems and processes must be established and operated effectively to prevent abuse (behaviour that is an offence under the Sexual Offences Act, ill-treatment whether physical or psychological, theft, misuse or misappropriation of money or property, and neglect), and to investigate immediately on becoming aware of any allegation or evidence of abuse. Care or treatment must not be provided in a way that includes discrimination on grounds of a protected characteristic, includes acts intended to control or restrain (force or threat of force to secure an act the service user resists, or restriction of liberty of movement by physical, mechanical or chemical means) that are not necessary to prevent, or not a proportionate response to, a risk of harm to the service user or another, is degrading, or significantly disregards the service user's needs. A service user must not be deprived of liberty for the purpose of receiving care or treatment without lawful authority.
