A registered person must comply with regulations 9 to 20A in carrying on a regulated activity (except to the extent another registered person has already done what is required). Care and treatment must be appropriate, meet the service user's needs and reflect their preferences; to achieve this the registered person must carry out, collaboratively with the relevant person, an assessment of needs and preferences, design care or treatment to achieve preferences and meet needs, enable relevant persons to understand the choices available and discuss the balance of risks and benefits with a competent professional, enable them to make or take part in decisions to the maximum extent possible, provide opportunities to manage the care, involve them in decisions about how the activity is carried on as it relates to the service user, give the information they reasonably need for these purposes, make reasonable adjustments, and have regard to well-being when meeting nutritional and hydration needs. For a service user aged 16 or over who lacks capacity the Mental Capacity Act duties apply, and where Part 4 or 4A of the Mental Health Act applies care must follow that Act.
