Part 3: access to records of private bodies – South Africa Promotion of Access to Information Act (PAIA)

South Africa Promotion of Access to Information Act (PAIA) s59-61: ss.59 to 61 Sever refusable parts, give access in the reasonably required form, and handle health records carefully

What does s59-61 require?

Every reasonably severable non-refusable part of a record must be disclosed, with grant and refusal notices for each part. After notification the head must give access as soon as reasonably possible in the form the requester reasonably requires or, if none, a form the head reasonably determines. Before releasing a health practitioner's record that might seriously harm the person it concerns, the head may consult a health practitioner nominated by that person (or a parent or curator) and release only if adequate counselling or arrangements are in place.
