Part 3: access to records of private bodies – South Africa Promotion of Access to Information Act (PAIA)

South Africa Promotion of Access to Information Act (PAIA) s53: ss.50, 53; reg. 7 Accept requests for records needed to exercise or protect rights, and help requesters

What does s53 require?

A requester must be given access to a private body's record where it is required to exercise or protect any right, the procedure is followed and no refusal ground applies (a state public body must also be acting in the public interest); this includes the requester's own personal information. Requests are made on Form 2 to the body's address, fax or email and must identify the record, requester, form of access, the right concerned and why the record is needed. Under the Regulations the information officer (including the head of a private body) must assist requesters and complete Form 2 for a requester who asks orally because of illiteracy or disability, giving them a copy.
