Part 3: access to records of private bodies – South Africa Promotion of Access to Information Act (PAIA)

South Africa Promotion of Access to Information Act (PAIA) s56-58: ss.56 to 58 Decide within 30 days, extend once with reasons, and give full notices

What does s56-58 require?

The head must decide and notify the requester within 30 days of receiving the request or the required particulars, unless third-party procedures apply. A grant notice states the access fee, the form of access and the right to complain to the Regulator or apply to court with the procedure and period; a refusal notice gives adequate reasons and the provisions relied on, without referring to the record's content, and the same challenge routes. The period may be extended once by up to 30 days for large volumes, remote searches, necessary consultation or written consent, with a reasoned notice within the original 30 days. Failure to decide in time is a deemed refusal.
