An employer whose work exposes employees to a physical agent consults the health and safety representatives or the committee concerned and tells them of the intention to carry out a physical agent exposure risk assessment, exposure monitoring and training, informs them of intended medical screening and surveillance, and shares the documented outcomes of the assessment, the monitoring and the screening and surveillance. Before any exposure, every employee likely to be exposed receives full information, instruction and training, practical and theoretical, on the content and scope of the Regulations, the potential sources and nature of the agent, its health and safety risks, the differing effects on men, women, young and vulnerable employees, the control measures in place and the need to comply with them including inspection, use, care, maintenance and limitations, the precautions employees take to protect themselves, the reasons for and outcomes of the risk assessment and monitoring and the need for and long-term benefits of screening and surveillance, the action level and OEL and their purpose, how defective control measures are reported, corrected and replaced, the matters in regulations 4 and 8 and how to access assessment, monitoring and personal medical records. Refresher training is given at least annually or more often if the committee or representative recommends, and mandataries and other non-employees who may be affected are informed and trained so far as reasonably practicable.
