Undertakings meeting the size, cross-border, investment, reinsurance and SCR criteria for two consecutive years may notify the supervisor to be classified as small and non-complex, with evidence, a declaration that no strategic change will breach the criteria within three years, and the proportionality measures they expect to use; the supervisor may oppose within two months (four for early requests). Internal model users and certain group parents never qualify. The undertaking must inform the supervisor without delay when a criterion is no longer met (classification ends after two consecutive years), report the measures used within a year, and notify changes. Other undertakings may use listed proportionality measures only with prior approval on a written request. Existing measures may continue for up to four financial years.
