Individual licensees must comply with the standard conditions in the Schedule to the Telecommunications (Licensing) Rules 2018 and any special conditions the Regulator sets by order under section 17; class licensees with the standard conditions (rules 6 and 7). The standard conditions require the licensee to comply with the Act, any regulations and the Regulator's rules, orders and directions; pay all applicable fees and levies; observe international conventions and agreements on telecommunications networks, services and radio spectrum to which Samoa is party unless exempted by order; indemnify the Government against actions, claims or proceedings arising from the licensee's breaches or failings; and take proper and adequate safety measures for all facilities under its direct or indirect control to safeguard life and property, including exposure to electrical emissions or radiation. Breach of a material condition allows amendment, revocation or non-renewal of the licence (sections 18 and 19), and a licence is taken to be revoked on conviction for offences of dishonesty, unlawful gain from the public or operating without a required licence or permit (section 18A).
