No person may provide a telecommunications service to the public for direct or indirect compensation, or own or operate a network used for such a service, except under a licence or an exemption order of the Regulator; the public includes people in Samoa or elsewhere and any segment of the public, and resale of another's services counts even if only one person is served (12(1)-(2)). Other services and networks need no licence (12(3)). Under the Telecommunications (Licensing) Rules 2018, an individual licence (term 20 years) covers public services and networks generally, and a class licence (indefinite term) covers a business at particular premises, such as a hotel, motel, hospital or cafe, where that business is the premises' main use and all customers are physically present there.
