Process safety management applies to construction work by incorporation: this section directs that, for construction work touching on process safety management for highly hazardous chemicals, the employer follows the requirements of 29 CFR 1910.119, the general industry process safety management standard. The construction section, added at 84 FR 21576 on 14 May 2019, carries no separate construction text of its own. As the heading and pointer indicate, the obligation concerns work in or on processes involving highly hazardous chemicals; for construction employers this typically arises when crews carry out new construction, turnaround, modification or maintenance work on such processes, often as contractors working inside a host employer's covered facility. Compliance is assessed against 1910.119 as written, so the construction employer's evidence must show the elements 1910.119 requires of it in the role it holds on the project, for example as a contractor employer at a covered process.
