OSHA Safety and Health Regulations for Construction (29 CFR Part 1926) 1926.53: 1926.53 Ionizing radiation

Construction and related work that uses sources of ionizing radiation is subject to the relevant occupational exposure provisions of the NRC radiation protection standards in 10 CFR part 20. Any work using X-rays or radioactive materials, licensed by the NRC or not, may only be done by competent persons with special training in operating that equipment properly and safely. Where the materials are used under a Commission license, the work may be performed only by persons actually licensed, or by competent persons working under the direction and supervision of the licensee. Paragraphs (c) through (r) are reserved in Part 1926; a note states that the construction requirements under those paragraphs are identical to paragraphs (a) through (p) of 29 CFR 1910.1096 (the general industry ionizing radiation standard), so the employer's obligations under 1910.1096 apply to construction work by incorporation. Common construction examples (not named in the text) are weld radiography and nuclear moisture-density gauges; for each such activity the employer needs a specially trained competent person and, for licensed material, the licensee or a competent person under the licensee's direction.
