OSHA Safety and Health Regulations for Construction (29 CFR Part 1926) 1926.59: 1926.59 Hazard communication

The construction hazard communication requirement is set by incorporation: a note in this section states that the requirements applying to construction work are identical to those in 29 CFR 1910.1200, the general industry Hazard Communication Standard. Part 1926 adds no separate construction text, so a construction employer's duties are those written in 1910.1200. As far as the pointer and its title indicate, this covers communicating chemical hazards to employees, which in practice for a construction employer means applying 1910.1200 to the hazardous chemicals brought onto or produced at each site, including chemicals used by subcontractors and multi-employer sites. Other Part 1926 sections rely on this one: for example the lead standard (1926.62) requires lead to be included in the hazard communication program and interim lead protection includes training under 1926.59. Because the obligation is incorporated rather than restated, an inspector will cite 1926.59 for construction work but assess compliance against the text of 1910.1200, and the employer's evidence must therefore show the elements that 1910.1200 itself requires.
