NSW Workplace Surveillance Act 2005 s20: s 20 Limits of a covert surveillance authority: unlawful activity only, supervised, no performance monitoring

A covert surveillance authority allows covert surveillance of employees at work only to find out whether particular named or identified employees are engaged in unlawful activity at work, and only under the oversight of the named surveillance supervisor and the other conditions set by or under the Act. It never authorises covert surveillance to monitor an employee's work performance, or in any change room, toilet, shower or other bathing facility.
