NSW Home Building Act 1989
Parts 3A and 3B: Building disputes and rectification orders – NSW Home Building Act 1989

NSW Home Building Act 1989 s48E: s 48E(5) Comply with an inspector's rectification order (licence condition)

After investigating a building dispute an inspector may order a contractor to complete incomplete work or rectify defective work or damage it caused (or a kit home supplier to supply, complete or rectify), specifying the steps, any conditions the owner must meet first (such as paying money due), stages if staged, and a compliance date; the order lapses if the matter becomes a building claim. It is a condition of every contractor licence that the contractor complies with a rectification order, and not complying without reasonable cause is improper conduct (s 51(2)(b)).
