NSW Home Building Act 1989 s17-18: ss 17 and 18 No misrepresentation about contractor licences or certificates

A person must not represent that an individual, partnership or corporation holds a contractor licence, or a licence authorising particular residential building work or specialist work, knowing it does not hold an appropriate one; nor represent that anyone holds a supervisor or tradesperson certificate, or one authorising particular work, knowing they do not. A licence or certificate is appropriate only if it covers the work represented. Representations may be express or implied, may concern a non-existent person, may be made by the person or its members, officers or employees, may be made through a business name and include advertisements to unidentified people (s 18). Maximum penalty 1,000 penalty units for a corporation and 200 otherwise.
