A kit home contract must expressly include the Schedule 2 Part 2 terms (the deemed inclusion does not satisfy the duty): all plans and specifications for the components, including variations, form part of the contract, and variations must be in writing signed by or for each party; and all components supplied will comply with the Building Code of Australia to the extent required under the planning legislation, with other codes, standards and specifications the law requires and with any development consent or complying development certificate conditions, with liability limitable only for owner-provided or owner-required designs after written advice. Regulations may add required or prohibited terms; inconsistent terms are unenforceable to that extent.
