A kit home contract term requiring arbitration of disputes is void. The contract gives the supplier no legal or equitable interest in land, any term purporting to create one is void and no caveat may be lodged over it, except a charge over the land on which the kit home is to be erected securing money a court or tribunal has ordered the buyer to pay (and, for Torrens land, only while the buyer is the registered proprietor).
