The Secretary may direct a developer (for building work under the Residential Apartment Buildings (Compliance and Enforcement Powers) Act 2020, the developer under that Act; otherwise the contractor licence holder) to stop residential building work where the way it is, or probably will be, done could cause significant harm or loss to the public or occupiers or significant damage to property, or, after a change of principal certifier or building practitioner, where it could stop the valid issue of an occupation certificate or building compliance declaration. The order may be conditional, takes effect when given or later, and lasts until revoked, its term ends or 12 months pass; the council and principal certifier are notified. A person must not fail to comply: 3,000 penalty units for a corporation plus 300 per day, and 1,000 plus 100 per day otherwise; it is also a disciplinary ground (s 56(n)). The Building (Approvals and Practitioners) Act 2026, not yet commenced, will recast the triggers around the approval authority, a building work compliance declaration and a completion approval.
