NSW Home Building Act 1989
Parts 7 and 8: Secretary functions, loose-fill asbestos and general provisions – NSW Home Building Act 1989

NSW Home Building Act 1989 s127: ss 127 and 127A Answer information notices and name the people doing the work

The Secretary or the Authority may by written notice require a person to give relevant information (possible offences, complaints, disciplinary investigations, licence applications, the solvency of licence holders and close associates, insurer licensing and investigations) in writing, produce documents or appear and answer questions; a person must not fail to comply to the extent able or knowingly give false or misleading information (1,000 penalty units for a corporation, 200 otherwise), and self-incrimination is no excuse, though answers are inadmissible in other criminal proceedings. An authorised person may also ask whoever controls residential or specialist work at a site, or an owner-builder, to name each person contracted to do the work and give their residential address; failing without reasonable excuse or giving a false name or address is an offence (200 penalty units) if the officer showed authority and gave a warning. A nominated supervisor is presumed to control the work.
