NSW Fair Trading Act 1987
Part 4: NSW consumer safety and information requirements (recalls, disclosure of prejudicial terms and referral fees, information standards, employment placement fees, industry codes, funeral goods, fuel prices) – NSW Fair Trading Act 1987

NSW Fair Trading Act 1987 54A-54E: Short-term rental accommodation: comply with the Code of Conduct

What does 54A-54E require?

Short-term rental accommodation industry participants (hosts, guests, letting agents, facilitators and online booking platforms) must comply with the Code of Conduct for the Short-term Rental Accommodation Industry declared under section 54B; contravening a provision identified by the code as an offence provision is an offence (1,000 penalty units for a corporation, 200 otherwise, section 54C), contravening a civil penalty provision exposes the participant to a court-ordered monetary penalty on the Secretary's application (section 54D), and the code prevails over inconsistent development consent conditions (section 54E). The code includes the exclusion register for hosts and guests who commit serious breaches, which platforms and letting agents must check.
