NSW Fair Trading Act 1987
Part 4: NSW consumer safety and information requirements (recalls, disclosure of prejudicial terms and referral fees, information standards, employment placement fees, industry codes, funeral goods, fuel prices) – NSW Fair Trading Act 1987

NSW Fair Trading Act 1987 47A: Disclose prejudicial terms before supplying goods or services

What does 47A require?

A supplier must, before supplying a consumer with goods or services, take reasonable steps to ensure the consumer is aware of the substance and effect of any term or condition of the supply that may substantially prejudice the consumer's interests: terms that exclude the supplier's liability, impose liability on the consumer for damage to delivered goods, permit the supplier to provide data about the consumer or its transactions to a third party in a form that could identify the consumer, or require the consumer to pay an exit fee, a balloon payment or other similar payment. Contravention is an offence; the regulations may specify what are and are not reasonable steps.
