NSW Fair Trading Act 1987 47B: Disclose referral fees, commissions and other financial incentives

What does 47B require?

An intermediary (a person who, in trade or commerce, arranges or facilitates the supply of goods or services to a consumer and receives a financial incentive from the supplier) must, before acting under an arrangement that provides for a financial incentive, take reasonable steps to ensure the consumer who will be supplied with the goods or services is aware of the existence of the arrangement. The regulations may prescribe what constitutes reasonable steps and exempt classes of intermediaries; the obligation covers referral fees, commissions and other benefits (for example referrals by real estate agents, mortgage brokers outside the credit regime, retailers and trades).
