New Zealand Credit Contracts and Consumer Finance Act 2003
Part 2: Consumer credit contracts (disclosure, cancellation, interest, fees, high-cost credit, payments, hardship) – New Zealand Credit Contracts and Consumer Finance Act 2003

New Zealand Credit Contracts and Consumer Finance Act 2003 46-54: Payments: credit payments on receipt, accept part and full prepayment, calculate the prepayment amount and rebate insurance, waivers and warranties

What does 46-54 require?

A creditor must credit each payment promptly once received (or as section 46 allows for post-dated or dishonoured payments), must date and adjust debits and credits as section 47 requires, must accept part prepayments and any full prepayment at any time, must not prohibit full prepayment, must calculate the amount required for full prepayment as section 51 and the regulations require (the unpaid balance plus accrued interest and fees less the rebates due, plus any permitted prepayment fee reflecting the creditor's reasonable loss), and must rebate the unexpired portion of consumer credit insurance, repayment waivers and extended warranties when the contract is prepaid, with the insurance contract terminating as section 53 provides.
