New Zealand Credit Contracts and Consumer Finance Act 2003
Part 2: Consumer credit contracts (disclosure, cancellation, interest, fees, high-cost credit, payments, hardship) – New Zealand Credit Contracts and Consumer Finance Act 2003

New Zealand Credit Contracts and Consumer Finance Act 2003 22-23: Disclose agreed changes before they take effect and unilateral changes within the required time

What does 22-23 require?

Where the parties agree to change a consumer credit contract, the creditor must disclose full particulars of the change (and any prescribed information) to every debtor before the change takes effect, or within the alternative timetable section 22 allows for changes that reduce obligations or are made at the debtor's request. Where the creditor uses a contractual power to make a change on its own (an interest rate or fee change, for example), disclosure must be made in the manner and within the time section 23 and the regulations require, with the exceptions for changes that benefit the debtor.
