New Zealand Credit Contracts and Consumer Finance Act 2003
Part 2: Consumer credit contracts (disclosure, cancellation, interest, fees, high-cost credit, payments, hardship) – New Zealand Credit Contracts and Consumer Finance Act 2003

New Zealand Credit Contracts and Consumer Finance Act 2003 27-31: Honour the debtor's right to cancel within five working days of initial disclosure and settle the consequences

What does 27-31 require?

A debtor may cancel a consumer credit contract by written notice within five working days of the day initial disclosure is made (or at any time if it has not been made), returning the property or paying the cash price as section 27 requires; the period is extended where disclosure is sent by post or electronically. The creditor must give effect to cancellation as sections 28 to 31 set out: the contract is treated as never entered into, advances must be repaid with any interest and fees the regulations allow, property is returned, and credit sale cancellation operates on the terms stated. Cancellation does not apply to the contracts section 29 lists.
