No consumer credit contract may carry an unreasonable credit fee or default fee. The creditor must keep records showing how each credit fee and default fee was calculated and that it was not unreasonable when set or reviewed, must review a fee when it knows or ought to know that it may have become unreasonable and at the intervals the regulations require, and must give the records to the FMA on request. Establishment fees are limited to the reasonable costs of the application, processing and documentation (or the average reasonable costs for that class), prepayment fees to the creditor's reasonable loss or the prescribed procedure, other credit fees and default fees to the reasonable costs and losses the sections describe, and third-party charges may be passed on only at the amount actually paid; following the Code counts as evidence of reasonable fees.
