New Zealand Commerce Act 1986
Part 2: Restrictive trade practices – New Zealand Commerce Act 1986

New Zealand Commerce Act 1986 37-42: No resale price maintenance: do not fix or enforce minimum resale prices or withhold supply to enforce them

What does 37-42 require?

No supplier or other person may engage in resale price maintenance: making it known that goods will not be supplied unless the buyer agrees not to sell below a specified price, inducing or attempting to induce a reseller not to sell below a specified price, agreeing to such a term, withholding supply or supplying on less favourable terms because the reseller has sold or may sell below a specified price, or using a statement of price in a way that amounts to a minimum. Genuinely recommended prices, clearly stated as recommended, are allowed; withholding and preventing supply are defined by sections 40 and 41 and section 42 sets evidentiary rules.
