New Zealand Commerce Act 1986
Part 2: Restrictive trade practices – New Zealand Commerce Act 1986

New Zealand Commerce Act 1986 36-36B: A business with a substantial degree of market power must not engage in conduct that substantially lessens competition

What does 36-36B require?

Anyone holding substantial market power is barred from conduct whose purpose, effect or likely effect is a substantial lessening of competition, whether in that market or in any other market where the person or an interconnected person deals, or will probably deal, in goods or services. The same bar applies to a holder of substantial power in a trans-Tasman market in relation to conduct affecting a New Zealand market, and purposes may be inferred from conduct and circumstances.
