New Zealand Commerce Act 1986
Part 2: Restrictive trade practices – New Zealand Commerce Act 1986

New Zealand Commerce Act 1986 30-30C: No cartel provisions: never fix prices, restrict output or allocate markets with competitors

What does 30-30C require?

No person may enter into a contract, arrangement or understanding, or give or demand a covenant, containing a cartel provision, and no person may give effect to one. A cartel provision is one whose purpose, effect or likely effect is price fixing, restricting output or market allocation (allocating customers, suppliers or territories) for goods or services supplied or acquired in New Zealand, between parties who compete with each other; sections 30A and 30B define those terms and cartel provisions are generally unenforceable.
