New York Labor Law Sections 203-c and 203-d (Employee Privacy: Recording in Restrooms and Personal Identifying Information) 203-d(3): Keep policies and procedures that safeguard against violations, including procedures to notify relevant employees

What does 203-d(3) require?

The Commissioner of Labor can levy a civil penalty reaching 500 dollars for a knowing breach. A violation is presumed knowing where the employer has no policies or procedures to safeguard against it, including a way of telling the staff concerned. The practical duty is therefore to maintain and communicate a written safeguard procedure.
