A manufacturer that supplies its goods for re-supply is liable to compensate a consumer (or a person deriving title) who suffers loss because the goods are not reasonably fit for a particular purpose made known to it directly or through the reseller, unless the unfitness arose after the goods left its control or the consumer did not reasonably rely on its skill or judgement (section 63). A person who supplies goods it manufactured is liable to compensate an individual who suffers loss or injury from a defect in them (section 64), with the defences that the defect did not exist at supply, arose only from compliance with a mandatory standard, could not be discovered on the scientific and technical knowledge of the time, or is attributable only to the design, markings or instructions of finished goods into which the component was incorporated (section 66). Where the manufacturer cannot be identified, the supplier must identify it on request or bear the liability (section 65).
