Kenya Competition Act (Cap. 504)
Part VI: consumer welfare – Kenya Competition Act (Cap. 504)

Kenya Competition Act (Cap. 504) 56: No unconscionable conduct towards consumers; all fees and charges disclosed before they are imposed

What does 56 require?

It is an offence, in trade, to treat a consumer in a way that, taking everything into account, is unconscionable, judged on the relative bargaining strength, whether conditions imposed were reasonably necessary to protect the supplier's legitimate interests, whether the consumer could understand the documents, whether undue influence, pressure or unfair tactics were used, and the price and terms available elsewhere (section 56(1) and (2)). In banking, micro-finance, insurance and other services, no unilateral charges or fees may be imposed unless they were brought to the consumer's attention before imposition or before the service was provided, and consumers are entitled to be informed of all intended charges and fees (section 56(3) and (4)).
