Part VI: consumer welfare – Kenya Competition Act (Cap. 504)

Kenya Competition Act (Cap. 504) 57: No unconscionable conduct in business-to-business transactions

What does 57 require?

It is likewise an offence, in trade, to engage in unconscionable conduct in supplying goods or services to, or acquiring them from, another business, judged on bargaining strength, unnecessary conditions, the business consumer's ability to understand the documents, undue influence or unfair tactics, the terms available elsewhere, consistency with the supplier's treatment of like customers, what any applicable industry code requires, unreasonable failure to disclose intended conduct or foreseeable risks, willingness to negotiate, and good faith (section 57). It complements the buyer power rules for suppliers and the trading terms imposed on small business customers.
