Japan Act on Specified Commercial Transactions (Act No. 57 of 1976) Art.6(1)(2): Art. 6(1)-(2) No false statements or intentional non-disclosure

When soliciting a door-to-door contract, or to prevent withdrawal or cancellation, the seller must not make false statements about the kind, performance, quality or content of the goods, rights or services, the price, payment timing and method, delivery timing, withdrawal and cancellation matters, the circumstances making the contract necessary for the customer, or other important matters affecting the customer's judgment; and must not intentionally withhold the facts on the first five of these when soliciting. A consumer misled by such a false statement or omission may rescind the application or acceptance (Article 9-3, within one year of being able to ratify and five years of the contract). Breach is a criminal offence under Article 70 (up to three years' detention or JPY 3 million, corporations up to JPY 100 million under Article 74), and the minister may demand reasonable grounds for performance claims (Article 6-2), a failure to produce them being deemed a false statement.
