Part 123: Licences for defense articles – ITAR - International Traffic in Arms Regulations

ITAR - International Traffic in Arms Regulations 123.9(a): Determine the true end user, end use and destination before applying or claiming an exemption

What does 123.9(a) require?

The country of ultimate destination on a licence application or on an EEI filing claiming an exemption must be the country of ultimate end use; the exporter must determine the specific end user, end use and destination before applying or claiming an exemption, reviewing all readily available information, public and from other parties; and written DDTC approval is needed before reselling, transferring, reexporting, retransferring, transshipping or disposing of a defense article to any end user, end use or destination not stated on the licence or EEI filing, unless an exemption explicitly allows it (123.9(a)).
