Part 123: Licences for defense articles – ITAR - International Traffic in Arms Regulations

ITAR - International Traffic in Arms Regulations 123.16(a)-(b)(1): Use the general hardware exemptions only within their limits, including for agreement support

The 123.16 exemptions do not apply to 126.1 destinations, exports needing congressional notification, Significant Military Equipment or MTCR Annex items, or generally ineligible persons, and every shipment, including to Australia, Canada and the UK, needs an EEI filing citing the exemption (123.16(a)). Hardware may be exported without a licence in furtherance of an approved manufacturing licence, technical assistance or distribution agreement or Category XIII(b)(1) distribution arrangement if identified by item, quantity and value in the agreement, the provisos are met, the EEI cites the exemption, the total value stays within the authorised amount, and for distribution agreements the export goes directly to the approved distributor (123.16(b)(1)).
