Part 123: Licences for defense articles – ITAR - International Traffic in Arms Regulations

ITAR - International Traffic in Arms Regulations 123.8 and 123.11: License transfers of USML aircraft, vessels and satellites and their foreign voyages

What does 123.8 and 123.11 require?

Transferring registration or control of a USML aircraft, vessel or satellite to a foreign person is an export needing DDTC approval wherever it is located, as is foreign registration of such an item located in the United States, which may also need Maritime Administration or FAA approval (123.8). A licence is needed when a privately owned USML aircraft or vessel makes a voyage outside the United States, unless it enters no foreign territorial waters or airspace and carries no defense articles as cargo; otherwise a DSP-73 is required (123.11).
