ITAR - International Traffic in Arms Regulations 123.3-123.4: License or correctly claim exemptions for temporary imports of defense articles

What does 123.3-123.4 require?

A DSP-61 licence is needed for temporary imports of unclassified defense articles returning to the country they came from or in transit to a third country (123.3). CBP may allow temporary import without a licence, for up to four years, of unclassified U.S.-origin items coming in for servicing, for enhancement or incorporation into an item already licensed for export, for exhibition or marketing, after rejection for permanent import, or under an FMS Letter of Offer and Acceptance, and temporary import (but not re-export) of articles to be modified or incorporated before a DSP-5 re-export (123.4(a)-(b)). The importer must be eligible, the ultimate consignee on export must match the foreign party at import, 126.1 countries are excluded, the foreign exporter must not need U.S. approval documents, and import and export filings must cite 22 CFR 123.4 (123.4(c)-(d)).
