The employer may not carry out checks on the fitness of an employee or on illness or injury. Absences for illness may be checked only through the inspection services of the competent social security institutions, which must perform the check when the employer asks. The employer may have a worker's physical fitness checked by public bodies and specialised public-law institutes. Violation is a criminal offence under art. 38. (Occupational health surveillance by the company doctor under D.Lgs. 81/2008 is a separate regime.)
